Karl Rove Agrees To Testify

Via Huffington Post:

A deal has been reached whereby Karl Rove will finally testify, under oath, before the House Judiciary Committee, according to chairman John Conyers' office.

Rove has long avoided and ignored subpoenas in the past by claiming executive privilege -- his deference now comes as a big victory for many Bush administration critics.

From HufPo commenter bethea3:

Do not get excited about this victory too soon.
This process still has a very long way to go. The incriminating documents still require review prior to Rove being questioned. Then his testimony will be reviewed against those records. Then he will be questioned again. Considering the volumes of paperwork involved it will be months before the gavel is struck.
I am grateful the the two administrations did not have to go head to head at this time on the issue of executive privilege. It will happen in the future but right now I would rather have BHO focused on the major issues affecting us all right now and not distracted by the likes of Rove and his ilk. That would be akin to going to war with Iraq when bin Laden is in another country altogether.
Is it just me or does it seem strange that the State Department got the bin Laden relations out of the country shortly after 9/11 even while the whole US was a not fly zone? Could that have any baring on why we never really pursued Osama to the ends of the earth? Did we use the distraction of the war to placate the bin laden family and not kill their son? Did we spend billions of dollars and 4000 plus American lives as a diversion? Those are the questions I want answered. And prosecuting, believe it or not, Rove may be the first step. Think about it.

FDR 1936

"I welcome their hatred!"

"“We had to struggle with the old enemies of peace — business and financial monopoly, speculation, reckless banking, class antagonism, sectionalism, war profiteering. ... Never before in all our history have these forces been so united against one candidate as they stand today. They are unanimous in their hate for me. And I welcome their hatred!"

And you said I was paranoid...

George W. Bush’s Disposable Constitution

By Scott Horton

Yesterday the Obama Administration released a series of nine previously secret legal opinions crafted by the Office of Legal Counsel to enhance the presidential powers of George W. Bush...

...We may not have realized it at the time, but in the period from late 2001-January 19, 2009, this country was a dictatorship. The constitutional rights we learned about in high school civics were suspended. That was thanks to secret memos crafted deep inside the Justice Department that effectively trashed the Constitution. What we know now is likely the least of it.

Anthrax spores don't match dead researcher's samples

via: George Washington's Blog

Sandia National Laboratories Test Exonerates Ivins

While government apologists are still trying to pretend there is a case that Bruce Ivins was the anthrax killer, tests by Sandia National Laboratories have exonerated him.

As the publisher of the prestigious scientific journal Nature writes:

At a biodefence meeting on 24 February, Joseph Michael, a materials scientist at Sandia National Laboratories in Albuquerque, New Mexico, presented analyses of three letters sent to the New York Post and to the offices of Senators Tom Daschle and Patrick Leahy. Spores from two of those show a distinct chemical signature that includes silicon, oxygen, iron, and tin; the third letter had silicon, oxygen, iron and possibly also tin, says Michael. Bacteria from Ivins' RMR-1029 flask did not contain any of those four elements.

Two cultures of the same anthrax strain grown using similar processes — one from Ivins' lab, the other from a US Army facility in Utah — showed the silicon-oxygen signature but did not contain tin or iron. Michael presented the analyses at the American Society for Microbiology's Biodefense and Emerging Diseases Research Meeting in Baltimore, Maryland.

It had previously been known that the killer anthrax contained silicon - an agent for weaponizing anthrax. But I have never previously read that the killer samples also contained iron and tin.

As the world's top anthrax experts have pointed out, Ivins did not possess either the know-how or the equipment to weaponize the anthrax. See this and this.

In addition, as Nature points out:

Ravel also sequenced the genome of a Bacillus subtilis strain that was found in one of the letters. That sample did not match a B. subtilis strain found in Ivins' lab, says Bannan, but the bacterial contamination still could have come from somewhere else in Ivins' institution.

There is simply no credible evidence incriminating Ivins.

Report: 'Dirty bomb' parts found in slain man's home

Report: 'Dirty bomb' parts found in slain man's home

Agency says radioactive materials recovered in home of man allegedly slain by his wife

BELFAST, Maine — James G. Cummings, who police say was shot to death by his wife two months ago, allegedly had a cache of radioactive materials in his home suitable for building a “dirty bomb.”

According to an FBI field intelligence report from the Washington Regional Threat and Analysis Center posted online by WikiLeaks, an organization that posts leaked documents, an investigation into the case revealed that radioactive materials were removed from Cummings’ home after his shooting death on Dec. 9.

The report posted on the WikiLeaks Web site states that “On 9 December 2008, radiological dispersal device components and literature, and radioactive materials, were discovered at the Maine residence of an identified deceased [person] James Cummings.”

The section referring to Cummings can be read here.

It says that four 1-gallon containers of 35 percent hydrogen peroxide, uranium, thorium, lithium metal, thermite, aluminum powder, beryllium, boron, black iron oxide and magnesium ribbon were found in the home.

Also found was literature on how to build “dirty bombs” and information about cesium-137, strontium-90 and cobalt-60, radioactive materials. The FBI report also stated there was evidence linking James Cummings to white supremacist groups. This would seem to confirm observations by local tradesmen who worked at the Cummings home that he was an ardent admirer of Adolf Hitler and had a collection of Nazi memorabilia around the house, including a prominently displayed flag with swastika. Cummings claimed to have pieces of Hitler’s personal silverware and place settings, painter Mike Robbins said a few days after the shooting.

An application for membership in the National Socialist Movement filled out by Cummings also was found in the residence, according to the report. Cummings’ wife, Amber B. Cummings, 31, told investigators that her husband spoke of “dirty bombs,” according to the report, and mixed chemicals in her kitchen sink. She allegedly told police that Cummings subjected her to years of mental, physical and sexual abuse. She also said that Cummings was “very upset” when Barack Obama was elected president.

A “dirty bomb” is a type of “radiological dispersal device” that combines a conventional explosive such as dynamite with radioactive material, according to the U.S. Nuclear Regulatory Commission’s Web site. “Most RDDs would not release enough radiation to kill people or cause severe illness,” the NRC says, adding that “a dirty bomb is in no way similar to a nuclear weapon” because its effects occur in a very limited area compared to a nuclear explosion.

The report noted that “uranium, thorium, cesium-137, stontium-90 and cobalt-60 are radioactive isotopes and 35 percent hydrogen peroxide is a necessary precursor for the manufacture of peroxide-based explosives. Lithium metal, thermite and aluminum are materials used to sensitize and amplify the effects of explosives.”

The report stated that the uranium component was bought online from a U.S. company that was identified in the investigation, but not in the report.

Pennsylvania rocked by 'jailing kids for cash' scandal

way to go Pennsy!

(CNN) -- At a friend's sleepover more than a year ago, 14-year-old Phillip Swartley pocketed change from unlocked vehicles in the neighborhood to buy chips and soft drinks. The cops caught him.

There was no need for an attorney, said Phillip's mother, Amy Swartley, who thought at most, the judge would slap her son with a fine or community service.

But she was shocked to find her eighth-grader handcuffed and shackled in the courtroom and sentenced to a youth detention center. Then, he was shipped to a boarding school for troubled teens for nine months.

"Yes, my son made a mistake, but I didn't think he was going to be taken away from me," said Swartley, a 41-year-old single mother raising two boys in Wilkes-Barre, Pennsylvania.

CNN does not usually identify minors accused of crimes. But Swartley and others agreed to be named to bring public attention to the issue.

As scandals from Wall Street to Washington roil the public trust, the justice system in Luzerne County, in the heart of Pennsylvania's struggling coal country, has also fallen prey to corruption. The county has been rocked by a kickback scandal involving two elected judges who essentially jailed kids for cash. Many of the children had appeared before judges without a lawyer.

The nonprofit Juvenile Law Center in Philadelphia said Phillip is one of at least 5,000 children over the past five years who appeared before former Luzerne County President Judge Mark Ciavarella.

Ciavarella pleaded guilty earlier this month to federal criminal charges of fraud and other tax charges, according to the U.S. attorney's office. Former Luzerne County Senior Judge Michael Conahan also pleaded guilty to the same charges. The two secretly received more than $2.6 million, prosecutors said.

The judges have been disbarred and have resigned from their elected positions. They agreed to serve 87 months in prison under their plea deals. Ciavarella and Conahan did not return calls, and their attorneys told CNN that they have no comment.

Ciavarella, 58, along with Conahan, 56, corruptly and fraudulently "created the potential for an increased number of juvenile offenders to be sent to juvenile detention facilities," federal court documents alleged. Children would be placed in private detention centers, under contract with the court, to increase the head count. In exchange, the two judges would receive kickbacks.
